Person in Interest

Some records, such as birth records, police or medical records that may be closed are available in some cases if the requestor is deemed a person in interest. A person in interest is the person who is the subject of the record in question, or that person’s designated representative.

Costs/fees

Agencies can charge a fee for copies, and if a PIA request will take considerable time to put together, they can charge for the time it takes to complete the request beyond the first two hours.

Charges should be established to recover actual costs and should not be used to generate profits for the agency.

Agencies can also ask that requestors prepay.

Requestors can ask for a waiver of fees if the information they are seeking is for a public purpose or will serve a public good.

The Attorney General’s office recommends that agencies have established fee schedules for copies and searches.
